DESCRIPTION OF WEEK OF LIFE SERVICES
Week of Life, s.r.o., ID No. 290 47 927, based at Pod zatáckou 1354, 156 00 Praha 5, registered in the Commercial Register lodged with the Municipal Court in Prague, Section C, File No. 162681 (hereafter simply “WOL”) provides users with access to www.weekoflife.com and related photographic, video and text content (hereafter simply “Website” ). Registered users may use their member account to upload and post photographs, video and text (hereafter simply “users”). Users may also edit and manage their personal profiles on the Website, browse and comment on the profiles of other users and communicate with other users, and hence the site also serves as a channel of communication.
Non-registered users may use the Website solely in accordance with the law and may not misuse information published on the Website for their own benefit or for the benefit of third parties.
1. General provisions
1.1 If you access or use the WOL website, a WOL service or any application made available by WOL, you consent to the fact that you are bound by these Terms of Service (hereinafter “Terms of Service”). These Terms of Service affect your statutory rights and obligations. If you do not consent to the fact that you are bound by all these terms, you will be unable to use or access the service.
1.2 By registering on the Website you declare and undertake to ensure that:
a) All the information you state in the registration is accurate and correct.
b) You will not state incorrect information on the Website and will not set up an account for any other person without their permission.
c) You will check and ensure that the information you give is correct.
d) Your use of the Website will not violate any laws.
e) You are not a convicted sexual offender.
f) You will keep your contact details correct and up to date.
g) You will not share your password with anyone, allow any third party to log in to your account or do anything else that could affect the security of your account.
h) You will not transfer your account created on the Website to a third party without our prior written consent.
1.3 These Terms of Service represent a legally binding agreement between you and WOL regarding your use of the Website and use of the Services.
1.4 These Terms of Service apply for all users of the Website and the Services, including users who also contribute photographs, information and other material or services on the Website.
2. Registration and account security
2.1 You must create an account and register in order to be able to use certain features of the Website or other services (hereafter simply “Services”).
2.2 Your account may be deleted and your right to use the Services may be revoked without warning, if:
a) We have reason to suspect that you are under the age of 18 and claim to be over the age of 18.
b) We have reason to suspect that you are over the age of 18 and claim to be under the age of 18.
2.3 If you register, you are responsible for keeping your password secret and secure.
2.4. You must immediately notify WOL of any security breach or unauthorised use of your account that comes to your attention.
2.5 You may not use the Service to slander, harass, bully, threaten, impersonate or intimidate other persons or entities and you may not publish private or confidential information about yourself or another person, such as credit card details or information on social insurance, or other identification data for public authorities, non-public telephone numbers or non-public e-mail addresses.
2.6. You may not misuse the Service for unlawful or unauthorised purposes. You consent to abode by all the laws, rules and regulations relating to your use of the Service and your content (as defined below), particularly the laws on the protection of copyright and the protection of personal data.
2.7. You are solely responsible for your actions and all data, texts, files, information, usernames, images, graphics, photos, profiles, audio and video clips, sounds, music, copyright works, applications, links and other content or materials that you send via the Website, publish or display.
2.8. You may not create or send other users unsolicited emails, comments or other forms of communication which are of an intrusive or commercial nature (“spam”). You may not disrupt the operation of the Service, the Website, server or networks associated with the Service, such as by transmitting worms, viruses, spyware, malware, or any other destructive or disruptive code. You may not insert code or otherwise change or disrupt the way in which the Website is drawn or displayed in the user’s browser or device.
2.9. You may not create unauthorised accounts on the Website, particularly for the use of automated devices, scripts, bots or internet robots (such as spiders, crawlers or scrapers).
2.10. You may not try to restrict other users in their use of the Service and also may not support or enable any breach of these Terms of Service or other terms of the Website.
2.11 Any breach of these Terms of Service may (at the discretion of WOL ) result in the termination of your account. You are aware and consent to the fact that WOL cannot be and will not will liable for content published on the Website and that you use the Website at your own risk. If you violate the provisions or intent of these Terms of Service or WOL in any other manner, you run the risk of possible prosecution and we may block your access to the Website, either partially or completely.
3. Your User Contributions (Content) and ownership rights
3.1 As the holder of an account on the Website you may send photographic, audio-visual or text content (jointly referred to hereinafter as “User Contributions” or “Content”). You are aware that regardless of whether the given User Contributions are published, WOL does not guarantee the confidentiality of any User Contributions.
3.2 You retain all your ownership rights to your User Contributions, with the exception of rights to contributions placed in the following three categories: WOL Logo, Editor’s Pick and Photo of the Day. By placing a contribution in the categories WOL Logo, Editor’s Pick and Photo of the Day, you transfer all copyright and licensing rights to WOL, with not entitlement to a fee. After placing Content in these categories you no longer have the right to remove that Content from the Website (WOL makes no claim to any other ownership rights to texts, files, images, photographs, videos, sounds, music, copyright works, applications or any other materials that you send to or via the Services. In the case of User Contributions not published in the categories WOL Logo, Editor’s Pick and Photo of the Day, you continue to retain any rights you have to your Content, with the exception of the limited licence specified in point 3.15. in these Terms of Service.
3.3 WOL does not support any User Contributions or opinions, recommendations or advice contained therein, and WOL explicitly denies any and all legal liability in connection with User Contributions.
3.4 You declare and guarantee that you possess (and will possess for the entire time that you use the Services) all the necessary licences, rights, permits and consents to enable WOL to use your User Contributions on the Website and to otherwise use your User Contributions in the manner intended by these Terms of Service. You consent to the fact that you must pay any copyright and licensing fees and other fees owed to any person or entity in connection with sending Content to or via the Website and by uploading the personal data of another person you explicitly state that you have their consent to the publication of their personal data on the WOL Website and also that you are aware that otherwise you are liable to WOL and the relevant third party for all damages or loss incurred as a result.
3.5 You consent to the fact that your conduct on the Website will be in accordance with (and you consent to the fact that all your User Contributions will be in accordance with) these Terms of Service.
3.6 You consent to the fact that you will not send or publish any User Contributions with content the possession or use of which is illegal in the country in which you reside or the possession or use of which in connection with the provision of the Services would be illegal for WOL.
3.7 You consent to the fact that you will not send or publish any User Contributions that are subject to any third-party property rights (including rights to the protection of privacy or rights to the protection of personality in published materials), unless you have a formal licence or permit from the lawful owner to publish the given material and to provide WOL with the licence specified in point 3.15 below.
WOL respects the intellectual property of others and we expect the same from our users. If you repeatedly violate the rights of others, WOL reserves the right to terminate your account.

3.8 WOL reserves the right (although is not obliged) to decide whether User Contributions comply with the requirements content requirements as defined by these Terms of Service and may at any time remove User Contributions and/or terminate user access for sending User Contributions that violate these Terms of Service, without prior warning at its own discretion.
3.9 You are aware and you consent to the fact that after your User Contributions have been sent, those User Contributions are published in all sections of the Website with the exception of the Last Added section. The Editorial Board evaluates all content sent in order to determine whether or not it violates these Terms of Service, particularly the points specified in point 4.1 of these Terms of Service.
a) The Editorial Board has the right to delete contributions that violate these Terms of Service
b) The Editorial Board will mark contributions as unsuitable for younger users in accordance with points 3.10.-3.12. of these Terms of Service.
User Contributions appear in the Last Added section after they have been evaluated by the Editorial Board. You are aware and you consent to the fact that this process is essential for ensuring the effective and secure operation of the Website and is primarily designed to benefit you and other users.
3.10 Certain User Contributions do not violate these Terms of Service yet are not necessarily suitable for all users. Such User Contributions will be marked as unsuitable for persons under the age of 18. The Editorial Board marks such contributions as unsuitable for persons under the age of 18 when it evaluates them. You may also mark your contributions as such yourself before sending your contribution. Other users also have the option to propose that other User Contributions be marked as unsuitable for persons under the age of 18; The Editorial Board will either approve such a proposal and mark the contribution as unsuitable for persons under the age of 18 or will reject the proposal.
3.11 Contributions unsuitable for persons under the age of 18 will not be accessible to non-registered users. They will only be accessible to registered users over the age of 18. Upon attempting to open such a contribution a warming window will appear informing the user that the contribution is unsuitable for persons under the age of 18 and that the user must be logged in.
3.12 User Contributions accessible only to persons over the age of 18 in accordance with point 3.10 are those that contain the following:
a) Sexually suggestive content;
b) Nudity;
c) Real violence or fictitious violence depicted in detail;
d) Bloody or frightening images shot in the appropriate context (with documentary value).
3.13 The Editorial Board will exercise great care when approving User Contributions that predominantly contain these aspects more than any other, to ensure that it is not the main purpose of the contribution. The aim is to enable users to document life in uncensored form and also to protect persons under the age of 18. User Contributions of a clearly pornographic, hateful or threatening nature will not be permitted by the Editorial Board. WOL reserves the right to decide in such matters.
3.14 You are aware and consent to the fact that when using the Services (including the Website) you may come across User Contributions that are inaccurate, offensive, indecent, or otherwise undesirable for you. You consent to the fact that you hereby waive all legal rights, claims of equity or remedies that you have or may have towards WOL in relation to any such User Contributions.
3.15 When sending or publishing a User Contribution on or via the Services you grant WOL a licence/consent to the unrestricted use of that User Contribution in connection with the provision of the Services (use, reproduction, distribution, creation of derivative works, the displaying and presentation of such and in any media formats and through any media channels, including use for partners of WOL) without entitlement to any fee. You are aware and, by sending a User Contribution, you consent to the fact that your User Contribution may particularly be used, disseminated and reproduced by WOL through Week of Life magazine, and that it may also be distributed to third parties, either for a fee or free of charge. After you remove your Content from the Website, we will no longer use it and will cease to make it available without undue delay. However, until that moment, the rights provided, as well as the rights of the National Library of the Czech Republic, ID No. 00023221, based at Klementinum 190, 110 00 Praha 1 (hereafter simply “National Library of the Czech Republic”) pursuant to point 3.16., continue to apply. You are also aware and, by sending a User Contribution, you consent to the fact that your User Contribution may be used (particularly disseminated and reproduced by partners of the Week of Life project, as a world chronicle of mankind (hereafter simply “Week of Life project” or simply “Week of Life”), including Denik published by Vltava-Labe-Press). The consent/licences you provide to WOL is non-exclusive and free of charge, with the right to provide a sublicence and transfer the licence.
3.16 This limited licence includes WOL’s right to use User Contributions or part thereof to promote the Week of Life project, in articles in the printed or electronic media, as well as in Week of Life magazine, which may be distributed to third parties for a fee or free of charge. All User Contributions or part thereof will archived for the duration of this contract, such as in the Webarchiv project, which has been implemented since 2000 by the National Library of the Czech Republic, and you grant your consent to your User Contribution being sent or published on the Website. You are also aware and you consent to the fact that the National Library of the Czech Republic is entitled to download, permanently store, reproduce and make available User Contributions via the internet on the relevant website of the National Library of the Czech Republic and that after the closure of your account or other termination of your relationship with WOL the rights the National Library of the Czech Republic remain valid until that time.
3.17 With the exception of User Contributions (apart from the exceptions specified above), all other content of the Services, particularly texts, software, written script, graphics, photographs, sounds, music, videos, and interactive features on the site is owned or licensed by WOL and is subject to copyright, trademark rights and other intellectual property rights of WOL or its licence providers (hereafter simply “WOL Content”). No third-party trademarks or service marks specified in the WOL content may be downloaded, copied, reproduced, distributed, transferred, broadcast, displayed, sold, licensed or otherwise used for any other purposes without the prior written consent of WOL or its licence providers. WOL reserves all explicitly non-granted rights to WOL content. WOL hereby grants you a limited revocable, and non-reproducible licence to reproduce and display WOL content (with the exception of software code) solely for your personal use in connection with browsing the Website and using the Services.
4. General restrictions on use
4.1 WOL hereby grants you permission to access and use the Services (including the Website), under the following explicit conditions, and you hereby consent to the fact that failure to comply with any of these Terms of Service will constitute a breach of the Terms on your part:
a) You consent to the fact that you will not disseminate any part or parts of the Website in any media without the prior written consent of WOL.
b) You consent to the fact that you will not change or modify any part of the Services (including the Website).
c) You consent to the fact that you will not access User Contributions or other content published on the Website using any technology or means other than those on the Website itself.
d) You consent to the fact that you will not (and will not attempt to) circumvent, disable or tamper with any security feature on the Website or feature which:
i. prevents or restricts the copying of any User Contributions or Content of the Website.
ii. restricts the use of the Website or the content available on the Website.
e) You consent to the fact that you will not use the Services (including the Website) for any commercial purpose without the prior written consent of WOL. Prohibited commercial usage includes, but is not limited to:
i. The further sale of access to the Website or any Service on another website for the purpose of profiting from advertising or subscriptions,
ii. The further of the Services (including any User Contributions available through the given Services) for the purpose of generating a profit from a similar or comparable business activity as that operated by WOL,
but does not include any use to which WOL has granted its explicit written consent.
f) You consent to the fact that you will not use or run any automatic system (including, but not limited to, any bot, or “spider” or “offline reader”), which, when visiting the Website, sends the WOL servers more requests than a person could send during the same amount of time using a publicly available standard (i.e. unmodified) web browser.
g) You consent to the fact that you will not collect or mine any of the personal data of any user of the Website or the Services (and you consent to the fact that this also includes the names of accounts on the Website).
h) You consent to the fact that you will not use the Website or Services (including communication and email features on the Website) to acquire contracts in connection with a business or in connection with a commercial enterprise.
i) You consent to the fact that you will not acquire any Website users for commercial purposes in connection with their User Contributions.
j) You consent to the fact that you will not access User Contributions for any purpose other than for your own personal, non-commercial use as intended or permitted by the general features of the Services.
k) You consent to the fact that you will not send or otherwise disseminate unauthorised commercial messages to users (such as spam).
l) You consent to the fact that you will not persecute, intimidate or harass any user.
m) You consent to the fact that you will not upload content of a hateful, threatening or pornographic nature, or which contains needless violence.
n) You consent to the fact that you will not develop or use third-party applications that contain, promote or otherwise offer alcoholic or other content unsuitable for persons under the age of 18 without the appropriate age limits.
o) You consent to the fact that you will not use the Website or WOL to do anything illegal, confusing, misleading or discriminatory, or allow or encourage any breach of these Terms of Service.
p) You consent to the fact that you will not add User Contributions which:
i. clearly constitute an attack or which promote racism, fanaticism, hatred or physical harm of any nature towards any group or person;
ii. abuse people in a sexual or violent manner;
iii. contain unreasonably violent or offensive violence content or contain links to websites suitable only for persons over the age of 18;
iv. publicly state information constituting a risk for anyone in relation to their security or the protection of their personal data;
v. contain or promote information that you know to be false or misleading or which promotes illegal activity or conduct which is violent, threatening, obscene, defamatory or which dishonours a third party or third parties;
vi. contain or promote illegal or unauthorised copies of third-party works copyrighted by the person in question, such as the provision of pirated computer software or links to such software, the provision of information to facilitate the circumvention of systems to prevent copying or the provision of pirated music or links to pirated music files;
vii. contains private, password-protected or hidden pages or images (which are not linked to or from another accessible page).
4.2 WOL reserves the right to reject or remove any User Contributions you post or any Content that breaches these Terms of Service.
5. Termination of relationship
5.1 These Terms of Service apply to you for the duration of the relationship between you and WOL. In the case of a licence granted to WOL while these Terms of Service are in effect, the licence remains valid after the termination of the relationship between WOL and the user.
5.2 You may terminate the relationship between you and WOL at any time by:
a) Notifying WOL.
b) Closing your account on the Website.
5.3 WOL may delete your account and thus terminate the relationship between you and WOL if:
a) You have violated any of the provisions of these Terms of Service (or have acted in a manner which clearly implies that you do not intend to or are unable to comply with these Terms of Service).
b) WOL is obliged by law to do so (such as if it is or becomes illegal to provide you with the Services).
c) WOL ceases to provide the Services to users in the country in which you reside or from which you use the Services.
d) It ceases to be commercially viable for WOL to provide you with the Services, at the discretion of WOL.
5.4 The termination of these Terms of Service does not affect any of the statutory rights, liabilities and obligations applicable to you or WOL (or which arose while these Terms of Service were valid and effective) or the validity of which is explicitly unrestricted, and the provisions of point 11.5 will apply to such rights, liabilities and obligations for an unlimited period.
6. Exclusion of guarantee
6.1 Nothing stated in these Terms of Service affects any of the statutory rights always applicable to you as a consumer.
6.2 The Services are provided “as they are” and WOL makes no declaration and provides no guarantee in connection thereto.
6.3 WOL particularly does not declare and does not guarantee that:
a) Your use of the Services will meet your requirements.
b) Your use of the Services will be uninterrupted, timely, secure and flawless.
c) Any information you acquire through your use of the Services will be accurate and reliable.
d) Shortcomings in the operation or functionality of any software provided to you as part of the Services will be rectified.
6.4 The Services are not covered by ant terms, guarantees or other conditions (including any expected terms concerning satisfactory quality, suitability for a specific purpose or compliance with descriptions), with the exception of those explicitly stated in these Terms of Service.
7. Limitation of liability
7.1 Nothing contained in these Terms of Service precludes or limits liability to WOL for losses which cannot be precluded or limited on the basis of the applicable laws.
7.2 With the exception of the general provision of point 11.5 below, WOL is in no way liable to you for:
a) Any indirect or consequential damages that you may incur (including any loss of profit - incurred either directly or indirectly, any loss of commercial value or reputation, or loss of data that you incur).
b) Any loss or damage you might incur as a result of:
i. Your relying on the completeness, accuracy or existence of any advertisement or as a result of any relationship or transaction between you and any advertiser or sponsor whose advertisement is displayed on the Website,
ii. Any changes that WOL makes to the Services, or any permanent or temporary suspension of the Services (or any features forming part of the Services),
iii. The deletion of, damage to or failure to store any User Contributions or other communication data stored or transmitted during or through your use of the Services,
iv. Your failure to provide WOL with accurate information for your account,
v. Your failure to keep your password or other details of your account on the Website secure and confidential
8. Declaration
8.1 WOL is in no way liable for and makes no explicit or assumed guarantees concerning Content or the accuracy and reliability of Content published on or via the Website and the Services, caused by the User or any hardware or programming associated with or used in connection with the Services and that Content does not necessarily reflect the opinions and practices of WOL.
8.2 Accounts and Content created and published by users on the Website may contain links to other websites. WOL is in no way liable for the content, accuracy, practices or opinions expressed on such websites, and such websites are not necessarily checked, monitored or reviewed by WOL with regard to their availability, accuracy or completeness. The inclusion of any links to other websites does not imply that WOL agrees with or supports such websites, products or other materials contained on or available via such websites.
8.3 You visit third-party websites at your own risk. WOL is in no way liable for third-party advertisements or third-party applications published on or through the Services and is in no way liable for goods or services provided by advertisers.
8.4 You are aware and you consent to the fact that WOL is in no way liable for any loss or damage you incur as a result of the availability of external sites or resources, or as a result of your trust in the completeness, accuracy or existence of any advertisement, product or material on or available from such sites or resources. WOL recommends that users proceed with caution when leaving the Website and read the terms of use and the terms governing the protection of personal data on each website they visit.
8.5 WOL does not provide your personal information or your Content to third parties or advertisers. However, you are aware that the Website is part of the Webarchiv of the National Library of the Czech Republic and you are aware of your rights and obligations in relation thereto, as specified primarily in point 3.16 above.
8.6 WOL is in no way liable for the online or offline conduct of any user of the Website or the Services. WOL is in no way liable for any error, omission, interruption, deletion, failure, delayed operation or transmission, communication line failure, theft or destruction, unauthorised access or the alteration of any of the user's communications. WOL is in no way liable for any problems or technical failures in any telephone network or line, online computer system, server or computer hardware or software provider, the malfunction of any email, browser or player caused by technical problems or heavy traffic on the internet or for any of the Services or combination of the above, including any injury or harm to users or their computers associated with or caused by participation in or the downloading of material in connection with the Services. WOL is under no circumstances liable for any loss or damage, including injury or death, resulting the use of the Services, participation at WOL events, as a result of any Content published on or via the Services or as a result of the conduct of any users of the Services, either online or offline.
9. Language of Terms
9.1 If WOL provides a translation of the Czech version of these Terms of Service, that translation is provided to you solely for your information. You hereby consent to the fact that your relationship with WOL will be governed by the Czech version of the Terms of Service.
9.2 If there is any discrepancy between the content of the Czech version of these Terms of Service and content of their translation, the Czech version is decisive.
10. Changes to the Terms of Service
10.1 WOL may change these Terms of Service from time to time. In such a case, WOL will publish the new version of the Terms of Service at the address http://www.weekoflife.com/storage/file/cz/terms.htm.
10.2 You are aware and consent to the fact that if you use the Services after the date on which the Terms of Service are changed, WOL will consider your use of the Services to constitute consent to the modified Terms of Service.
11. General legal conditions
11.1 These Terms of Service represent a complete agreement between you and WOL, govern your use of the Services and the Website and complete supersede any previous agreements concluded between you and WOL in connection with the Services and use of the Website.
11.2 If you grant WOL your separate consent, WOL will send you notifications by email, by post or notifications published on the Website; otherwise, WOL will only send you technical messages.
11.3 You consent to the fact that if WOL does not exercise or enforce any legal right or remedy contained in the Terms of Service (or which WOL has the right to exercise or enforce under the relevant legislation), this will not constitute a formal waiver of its rights on the part of WOL and such rights and remedies will continue to be available to WOL.
11.4 If any court with the relevant jurisdiction rules in a particular case that any of the provisions of these Terms of Service are invalid, those provisions will be removed from of the Terms of Service; this will not affect the other provisions of the Terms of Service. The remaining provisions of the Terms of Service will remain valid and effective.
11.5 These Terms of Service and your legal relationship with WOL established thereby will be governed by Czech law. You and WOL undertake to comply with the jurisdiction of the courts in the Czech Republic competent to rule on any legal matters that arising in connection with these Terms of Service. Regardless of this fact, you consent to the fact that WOL will continue to have the right to enforce remedies (or other similar provisional measures) in any jurisdiction.
11.6 You are fully liable for your interaction with other users of the Services (including the Website). WOL reserves the right to, although is not obliged to, get involved in any dispute that arises between you and other users.
11.7 WOL is constantly innovating in order to provide its users with the best possible services and experience. You are aware and you consent to the fact that the form of the Services provided by WOL may change from time to time without prior notification.
11.8 You are aware and you consent to the fact that as part of this continuous process of innovation WOL may (permanently or temporarily) suspend the provision of the Services (or certain features included in the Services) for you or users in general, at its own discretion, without prior notification. You have the right to stop using the Services at any time. You are not obliged to inform WOL that you are ceasing to use the Services.
11.9 You consent to the fact that you are fully liable (and that WOL is in no way liable to you or any third party) for any breach of your obligations under these Terms of Service and for the consequences of such a breach (including any loss or damage potentially incurred by WOL).
12. Protection of personal data
12.1. In connection with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereafter simply “GDPR”) and other applicable regulations governing the protection of personal data WOL (or the “controller”) is the controller of personal data and administers the personal data entered in the user profile, such as the user’s first name and surname, date of birth, address, photographs, email, etc. (hereafter simply “personal data”).
12.2. WOL processes users’ personal data in accordance with the GDPR and other regulations, solely for the purpose of operating the Website and the creation of the archive of the National Library of the Czech Republic. WOL passes personal data solely to the National Library of the Czech Republic, for the purpose of creating the archive and world chronicle of mankind. WOL does not pass users’ personal data on to any other entities or international organisations, including those abroad.
12.3. By entering their personal data in the user profile on the Website users are aware that this personal data will be stored on the Website.
12.4. Users’ full name and photographs may also be published/made accessible to other users. In this case the full name may be entered into the user’s profile solely with the explicit consent of the user. It will not be technically possible to enter the user’s full name into the profile without this consent. By entering this personal data you are also aware that this personal data will be visible to all registered users and also to third parties using the Website.
12.5. The user’s full name constitutes a two-word collocation, which, depending on character, comprises the user’s name and surname as commonly used within the company, and which serves to identify that particular individual, e.g. Jan Novák.
12.6. If a user does not want to publish their full name on their profile and by photographs so it is visible to third parties and users, the user does not have to grant WOL consent to processing their full name and may simply enter a nickname into their profile, which will be displayed by photographs and all User Contributions. This nickname is a username that does not contain the characters of the first name and surname specified in point 12.5. of these Terms of Service and is the fictitious name of the user.
12.7. All registered users and other persons whose personal data is processed by WOL are classed as data subjects in accordance with the laws governing the protection of personal data.
12.8. The user’s email address will be processed by the controller solely with the user’s explicit consent, and solely for the purpose of sending invitations to meetings, events, offers, birthday wishes, etc. The user may provide WOL with consent to the use of his or her email address for this purpose in the user profile and may also revoke such consent in the profile at any time.
12.9. A data subject whose personal data is processed by the controller has the right to file a written request with the controller for information about what personal data is processed and in what manner, and also has the right to request that such data be corrected, supplemented, changed or deleted, or that the processing of such data be restricted in accordance with the applicable legislation, and is also at any time entitled to file a complaint against the processing of personal data to which the user has not granted consent, as well as the right to the portability of personal data to a different controller. The user also has the right to file a complaint with the supervisory authority.
12.10. The data subject has the right to exercise all of the rights specified in Article 12.9. of these Terms of Service, by sending either an email to the address specified on the controller’s website or a printed letter to the controller’s registered address.
12.11. If data subject files a request in electronic form, the information is provided in a commonly used electronic form, unless the data subject requests that the information be provided in a different form. It is always necessary to verify the identity of the person who files a request in electronic form, to prevent any unauthorised access to the information (the method and extent of this check should correspond to the context, scope and sensitivity of the information requested). Electronic communication is only permitted from the electronic address registered in the user’s profile.
12.12. Information must be provided without undue delay, always within one month of receipt of the request. This deadline may be extended by two months in exceptional cases, in which case the data subject must be informed by the controller, including the reasons for the delay.
12.13. Information is generally provided free of charge. Only in cases where a request filed by a data subject is clearly unreasonable or disproportionate may the controller either charge an appropriate fee or refuse to comply with the request, in which case the controller must provide proof of why the request is unreasonable or disproportionate.
12.14. If the data subject is in any way dissatisfied with the processing of his or her personal data by the controller, a complaint may be filed either with the controller, or with the Office for Personal Data Protection.

13. Final provisions
13.1. Any disputes between WOL and the User many also be resolved out of court. In such a case the User – a consumer – may contact an alternative dispute resolution entity, such as the Czech Trade Inspection Authority, or have the dispute resolved on-line via the appropriate ODR platform. More information about extra-judicial dispute resolution can be found here (link). Before taking steps to resolve a dispute out of court, WOL recommends that the User first contact WOL in order to resolve the matter.
13.2. These Terms of Service and all parts thereof are valid and effective from 25 May 2018 and supersede all previous Terms of Service and all parts thereof, which are available from WOL head office.
